Item 8.01 Other Events.
As previously disclosed, a trial was set for September 2010 for a case against NuVasive, Inc., a Delaware corporation (the Company), in the Central District of California (Case No. 2:09-cv-06988-R-JEM) involving alleged trademark infringement and unfair competition. An unfavorable verdict from the U.S. District Court for the Central District of California was delivered against the Company in its use of the NeuroVision name. NuVasive intends to timely appeal the decision.
