Other Events
 
On February 3, 2010, Central Hudson Gas & Electric Corporation (“Central Hudson”) issued a press release announcing that Central Hudson, the Staff of the New York State Public Service Commission and Multiple Interveners (a consortium representing large industrial users) have reached an agreement and filed a proposal on a multi-year rate plan that, if approved by the New York State Public Service Commission (“NYPSC”), would phase in increased electricity and natural gas delivery rates for Central Hudson’s customers during the three years commencing as of July 1, 2010.  The NYPSC’s Administrative Law Judge has directed that hearings be held in late February 2010 to consider the reasonableness of the agreement and to permit evidence to be offered in support of, or in opposition to, the agreement.  The NYPSC will subsequently decide, by June 2010, whether to approve the agreement.  The press release issued by Central Hudson is attached hereto as Exhibit 99 and incorporated herein by reference.
